Who is responsible

The controller under the General Data Protection Regulation (GDPR) is Moritz Pommer, Taunusanlage 8, 60329 Frankfurt am Main, Germany, hello@mohig.com.

No cookies, no tracking

This site sets no cookies and uses no analytics or tracking of its own. Its fonts, pictures and hosted music come from its own server. Your browser remembers one setting in its local storage, whether you turned the sound on, and that setting never leaves your device (§ 25 (2) No. 2 TDDDG). The players of other services load only when you press play (see Players).

Hosting

The site is hosted by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, United States, which processes data for me under a data processing agreement (Art. 28 GDPR). When you visit, its servers record what your browser sends: your IP address, the date and time, the page requested, your browser and the page you came from. This keeps the site secure and working, which is my legitimate interest (Art. 6 (1) (f) GDPR). Vercel keeps the request logs it shows me for one day; what it keeps longer for its own security is covered by its privacy notice. Transfers to the United States rest on Vercel's certification under the EU-U.S. Data Privacy Framework (Art. 45 GDPR) and on the European Commission's Standard Contractual Clauses (Art. 46 (2) (c) GDPR).

Players

Some tracks and mixes play through Spotify, SoundCloud, Mixcloud or Bandcamp. Nothing from these services loads until you press play. When you do, your browser connects to that service, which receives your IP address and browser information and may set its own cookies. Some players also load other services, such as Google Analytics (Bandcamp), Facebook, Cloudflare and Sentry (Mixcloud), or Sentry (Spotify).

Loading the player you asked for is based on § 25 (2) No. 2 TDDDG, and the processing serves my interest in playing the music where it is published (Art. 6 (1) (f) GDPR). For the moment your browser connects, that service and I are jointly responsible (Art. 26 GDPR); for what it does afterward, the service alone is responsible, under its own privacy policy. Spotify and SoundCloud are based in the EU, and Mixcloud in the United Kingdom, which the EU recognizes as adequate (Art. 45 GDPR). Bandcamp is based in the United States and names no Data Privacy Framework certification, so a Bandcamp player sends data there without that protection.

Booking and email

The booking form sends nothing itself. It opens your own mail app with your request written out, and you decide whether to send it. When you write to hello@mohig.com, I use your name, email address and message to answer you, and my email provider stores the message for me. The legal basis is Art. 6 (1) (b) GDPR when you ask about a booking, otherwise Art. 6 (1) (f) GDPR, my interest in answering you. I delete messages once they are handled, unless tax law requires me to keep them (§ 147 AO).

Mailing list

If you sign up for the mailing list under Dubplates, I use your email address to send you news about new releases, before they come out elsewhere. You get a confirmation email first, and you are on the list only after you click the link in it (double opt-in). The legal basis is your consent (Art. 6 (1) (a) GDPR). You can withdraw it at any time through the link in every email or by writing to hello@mohig.com. Your address stays on the list until you unsubscribe.

The list is run by Sendinblue SAS (Brevo), 17 rue Salneuve, 75017 Paris, France, which processes the address for me under a data processing agreement (Art. 28 GDPR) and records when you signed up and confirmed, as proof of your consent. Where Brevo uses service providers outside the EU, its agreement covers the transfer with the European Commission's Standard Contractual Clauses (Art. 46 (2) (c) GDPR).

Stage mode

In stage mode (mohig.com/?stage), the button Listen to the room lets the picture move with the music in the room. Only when you press it does the site ask for your microphone, and it listens only after you allow it in your browser. Press the button again, or withdraw the permission in your browser, to stop it. The sound is analyzed on your device only. It is never recorded, stored or sent.

Your rights

You have the right to access your data (Art. 15 GDPR), to have it corrected (Art. 16) or deleted (Art. 17), to restrict its processing (Art. 18) and to receive it in a portable form (Art. 20). A simple email to hello@mohig.com is enough. You can also complain to a data protection supervisory authority (Art. 77 GDPR).

Your right to object

Where processing rests on Art. 6 (1) (f) GDPR, you can object to it at any time on grounds relating to your situation (Art. 21 GDPR).
